1. Agreement to Terms

By accessing or using AutoMarketer Pro ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

AutoMarketer Pro is a marketing automation platform that provides tools for email marketing, campaign management, lead generation, analytics, and related marketing services. The Service is provided on a subscription basis.

3. User Accounts

3.1 Account Creation

To use the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password and account
• Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited emails, or violate anti-spam laws
• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Transmit any harmful, offensive, or illegal content
• Interfere with or disrupt the Service or servers

• Use automated systems to access the Service without permission

5. Payment Terms

5.1 Subscription Fees

Subscription fees are billed in advance on a recurring basis (monthly or annually) according to your selected plan. All fees are non-refundable except as required by law.

5.2 Price Changes

We reserve the right to modify subscription fees at any time. We will provide at least 30 days' notice of any price changes to existing customers.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by AutoMarketer Pro and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of any content you create using the Service.

7. Service Availability

We strive to maintain the Service's availability but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control. We aim for 99.9% uptime but do not guarantee it.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by contacting us or using the account deletion feature.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AUTOMARKETER PRO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law provisions.
